Terms of service

Welcome to BreezeandBough. These Terms of Service (the "Terms") govern your access to and use of breezeandbough.com, our online store, and the products and services available through it (collectively, the "Services").
These Terms are between you and BreezeandBough, an online store operated by an individual trader based in China ("BreezeandBough," "we," "us," or "our"). Our store is hosted by Shopify, which provides the ecommerce platform that enables us to offer the Services to you.
By accessing the Services or placing an order, you agree to these Terms and the policies referenced in them. If you do not agree, please do not use the Services. Nothing in these Terms limits any consumer right that cannot lawfully be excluded or restricted.
1. Eligibility and account information
You must be at least the age of majority in your place of residence, or use the Services with the involvement and consent of a parent or legal guardian. If you create an account or place an order, you agree to provide accurate, current, and complete information.
You are responsible for safeguarding your account credentials and for activity conducted through your account. Please contact us promptly if you believe your account or payment information has been used without authorization.
2. Handmade products and natural variation
Our products are handmade from wood and other natural materials. Grain, color, knots, texture, tool marks, carving details, and small differences in shape or dimensions will naturally vary from piece to piece. These characteristics are part of the handmade nature of the product and are not defects.
We make reasonable efforts to display products accurately. However, colors and details may appear differently because of lighting, photography, screen settings, and variations in natural materials. Product dimensions are approximate unless the product page states otherwise.
Unless a product listing expressly states that an item is a toy, our carvings are decorative objects and are not intended as toys. Keep decorative products, packaging, and any small or detachable parts away from young children.
3. Custom and personalized orders
For personalized, custom, or made-to-order products, you are responsible for checking all names, wording, specifications, reference materials, and other details before submitting the order or approving a design.
Because these products are created specifically for you, they cannot normally be cancelled after production begins and are not eligible for change-of-mind returns. This does not affect your rights if an item arrives damaged, defective, materially different from the approved specifications, or incorrect, or if applicable law gives you additional rights.
4. Orders and acceptance
Submitting an order is an offer to purchase. An automated order confirmation acknowledges receipt but does not necessarily mean that we have accepted the order. We accept an order when we confirm acceptance or begin fulfilling it.
We may reject or cancel an order for legitimate reasons, including product unavailability, an obvious pricing or description error, payment or fraud concerns, shipping restrictions, suspected resale, or an inability to complete a custom request. If we cancel an order after payment has been collected, we will refund the amount paid for the cancelled item and any related shipping charge.
Please review your order and delivery address carefully before submitting it. Contact us within 24 hours if you need to request a cancellation or correction. We will try to help, but a change or cancellation cannot be guaranteed once production or fulfilment has started. Custom orders cannot be cancelled after production begins, except where applicable law requires otherwise.
5. Prices, payment, taxes, and customs
Prices are displayed in U.S. dollars unless otherwise stated. The price charged is the price shown at checkout when your order is submitted. Shipping charges and taxes collected by us, if any, will also be shown at checkout.
You authorize us and our payment providers to charge the payment method you select for the total shown at checkout. You confirm that you are authorized to use that payment method and that your billing information is accurate.
For international orders, your destination country may impose import duties, taxes, customs charges, or handling fees. Unless these charges are expressly included at checkout or applicable law requires us to pay them, they are the customer's responsibility. Customs processing may also affect delivery time.
6. Shipping and delivery
Processing and delivery times are estimates rather than guarantees. Handmade production, carrier disruptions, customs processing, severe weather, public holidays, or other events outside our reasonable control may cause delays. If a material delay occurs, we will provide notice and any cancellation or refund options required by applicable law.
You are responsible for providing a complete and accurate delivery address. If a parcel is returned because the address supplied was incorrect or incomplete, or because delivery was refused or not collected, additional reshipping charges may apply where permitted by law.
Risk of loss transfers as provided by applicable law and will not transfer to a consumer merely because we handed the parcel to a carrier. Please see our Shipping Policy for current processing estimates, delivery information, and instructions for delayed, lost, or damaged parcels.
7. Returns, refunds, and problems with an order
Eligible standard, non-custom products may be returned within 30 days after delivery, subject to the conditions in our Refund Policy. For a change-of-mind return, the customer is normally responsible for return shipping costs. We do not charge a restocking fee.
Custom, personalized, and made-to-order products are not eligible for change-of-mind returns unless applicable law requires otherwise. Natural wood grain, color differences, tool marks, and minor handmade variations described in Section 2 are not defects.
If your order arrives damaged, defective, or incorrect, contact us as soon as possible and preferably within 7 days of delivery, with your order number and clear photographs of the item and packaging. This notification request helps us investigate quickly and does not shorten any mandatory legal right or warranty period.
Return eligibility, return instructions, refund timing, and exceptions are explained in our Refund Policy. These Terms and our Refund Policy do not exclude any non-waivable right you may have under applicable consumer law.
8. Product information, availability, and corrections
We may update product descriptions, prices, availability, or other store content. We may also limit quantities or discontinue products. Changes will not alter the price of an order we have already accepted, except where we correct an obvious error and applicable law permits it.
If store information contains a typographical, pricing, availability, or other material error, we may correct it. If the error affects an order you placed, we will contact you when reasonably possible and give you the option to confirm the corrected order or receive a refund if we cannot fulfil it as originally agreed.
9. Intellectual property
The store and its content, including our name, logos, product designs, photographs, videos, text, graphics, and layout, are owned by or licensed to BreezeandBough and are protected by applicable intellectual property laws.
You may view and use the store for personal, non-commercial shopping. Without our prior written permission, you may not reproduce, modify, distribute, sell, publish, commercially exploit, or create derivative works from our content, except where applicable law permits such use. Shopify names and marks belong to Shopify or its licensors, and other third-party marks belong to their respective owners.
10. Third-party services, links, and Shopify
We may use third-party services for hosting, payments, analytics, shipping, social media, or other store functions. Those services may be governed by their own terms and privacy policies. Links to third-party websites are provided for convenience; we do not control and are not responsible for their independent content, products, or practices.
Shopify hosts our ecommerce platform, but purchases from this store are transactions directly between you and BreezeandBough. Shopify is not the seller of our products and is not responsible for fulfilling your order or handling product claims. Nothing in this paragraph limits any rights you may have directly against Shopify under applicable law or under a separate agreement with Shopify.
11. Privacy
Our collection and use of personal information are described in our Privacy Policy. Because Shopify hosts the store, Shopify and other service providers may process information in order to operate the Services, complete transactions, prevent fraud, and provide related functions. Please review the Privacy Policy before using the Services.
12. Reviews, feedback, and submitted content
If you submit a review, photograph, suggestion, or other content to us, you retain ownership of your content but grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, display, and distribute it for operating, improving, and promoting our business and products, subject to applicable privacy and consumer laws.
You confirm that you have the right to submit the content and that it is accurate, lawful, and does not infringe another person's intellectual property, privacy, publicity, or other rights. We may remove submitted content that is unlawful, abusive, misleading, infringing, or otherwise violates these Terms. We are not required to publish or respond to submissions.
13. Prohibited uses and automated access
You may not use the Services to:
- violate any law or another person's rights;
- submit false, fraudulent, defamatory, abusive, or misleading material;
- introduce malware or interfere with the security, availability, or operation of the Services;
- collect personal information about others without authorization;
- impersonate another person or misrepresent your identity;
- circumvent access controls, purchase limits, fraud controls, or technical protections; or
- scrape, copy, extract, or use store content through automated means in a way that burdens the Services, bypasses technical restrictions, or infringes our or another person's rights.
We may restrict or block access reasonably believed to violate this section.
14. Disclaimers and limitation of liability
We aim to keep the Services accurate and available, but we do not guarantee that access will always be uninterrupted, secure, or error-free. To the fullest extent permitted by law, the Services are provided "as available," and we disclaim implied warranties that may lawfully be excluded.
This disclaimer does not apply to express product promises we make, statutory guarantees, or warranties and consumer rights that cannot lawfully be excluded. Nothing in these Terms excuses us from supplying goods that conform to the contract or from providing remedies required by applicable law.
To the fullest extent permitted by law, BreezeandBough will not be liable for indirect, incidental, special, punitive, or consequential losses that were not reasonably foreseeable when the contract was formed, including lost profits, lost revenue, or loss of data arising from use of the Services.
Where liability may lawfully be limited, our aggregate liability arising from an order will not exceed the amount you paid for the product giving rise to the claim. This limit does not apply where limitation is prohibited, including liability for fraud or fraudulent misrepresentation, wilful misconduct or gross negligence, or death or personal injury caused by negligence where applicable law does not allow that liability to be limited. It also does not limit mandatory consumer remedies for damaged, defective, incorrect, or undelivered goods.
15. Responsibility for misuse
To the extent permitted by law, you are responsible for reasonable losses, liabilities, and costs that we incur as a direct result of your unlawful use of the Services, your material breach of these Terms, or your infringement of another person's rights. This section does not require a consumer to compensate us for losses caused by our own breach, negligence, or unlawful conduct.
16. Suspension and termination
We may suspend or terminate access to the Services if you materially violate these Terms, misuse the Services, threaten their security, or engage in fraud or unlawful activity. Where appropriate, we will give reasonable notice. Termination does not affect rights and obligations that arose before termination, including your obligation to pay for accepted orders and our obligation to fulfil or refund them as applicable.
Sections that by their nature should continue after termination, including intellectual property, submitted-content licenses, liability provisions, governing law, and dispute terms, will survive.
17. Governing law and disputes
Before starting formal proceedings, please contact us so we can try to resolve the issue directly.
These Terms and any contract formed through the Services are governed by the laws of the People's Republic of China, without regard to conflict-of-law principles. Subject to any mandatory right you have to bring a claim elsewhere, the courts with jurisdiction over Yiwu, Zhejiang, China will have jurisdiction over disputes arising from these Terms or the Services.
If you are a consumer, this choice of law and forum does not deprive you of mandatory protections or dispute rights provided by the law of your country or region of residence that cannot be excluded by agreement.
18. General terms, changes, and contact information
If any part of these Terms is held unlawful or unenforceable, that part will be enforced to the greatest extent permitted or severed, and the remainder will continue in effect. A delay in enforcing a right is not a waiver of that right.
These Terms, together with the policies and terms referenced in them and any product-specific terms disclosed before purchase, form the agreement between you and us regarding the Services and your order. If product-specific terms conflict with these Terms, the more specific terms apply to that product, subject to applicable law.
You may not transfer your rights or obligations under these Terms without our consent. We may transfer our rights and obligations as part of a sale, transfer, or reorganization of the business, provided that doing so does not reduce your rights under an accepted order or applicable consumer law.
We may update these Terms by posting a revised version on this page and changing the effective date. Where required by law, we will provide additional notice of material changes. Changes apply from the stated effective date and will not retroactively reduce rights attached to an order already accepted.
